Accused child killer Nathan Shaw had a preliminary hearing scheduled late last week on parole violations.
Shaw decided to waive his right to the hearing, according to Lauren Taylor, a spokesperson for the state’s probation and parole board.
At the end of this week, the 25-year-old Shaw faces a preliminary hearing on murder and other charges stemming from the stabbing death of six-year-old Jared Klein and the beating and rape of the boy’s mother on Dec. 26.
At the time of the crimes in Tyrone, Shaw was on parole and was spending time at a halfway house in Cambria County. Shaw was permitted to leave the halfway house on a holiday furlough. He was due back there the night of the boy’s murder. Shaw allegedly stole a car belonging to the boy’s mother and left the area. He was apprehended on Dec. 28 in Oklahoma after a high-speed chase and car crash.
Authorities eventually decided to drop charges against Shaw in Oklahoma to allow his return to Pennsylvania on the parole violation. Shortly after his return, Shaw was charged with the Dec. 26 crimes.
Shaw’s parole issues will be dealt with at a violation hearing, according to Taylor. She said the parole board would then decide on what action to take about Shaw. If the board decides Shaw violated parole he would be required to serve the remainder of a sentence he received for theft and assault charges.
Taylor said if Shaw were found guilty of the parole violations when he would serve the remainder of his sentence would be determined by the outcome of the murder and other charges against him. If found guilty in the murder case, Shaw would have to serve that sentence first. The remainder of his state prison sentence would stay on the books and would have to be served if Shaw completed his sentence in the murder case or was released for some reason such as parole or a commutation of his sentence.
As for Shaw’s preliminary hearing in the murder case, it was continued by Magisterial Judge Fred Miller to this Friday. The hearing was moved from Judge Miller’s office to the Blair County Courthouse in Hollidaysburg. The hearing is scheduled to begin at 10 a.m.
