Nathan T. Shaw, the man accused of killing six-year-old Jared Klein in Tyrone on the day after Christmas last year, is now set to go on trial in January of next year.
Jury selection in the case against the 25-year-old man has been set for Jan. 8 and his trial is scheduled to start on Jan. 16.
Shaw was arrested on murder and other charges in January of this year. He was apprehended in Kay County, OK two days after the murder of the young Tyrone boy.
Authorities in Oklahoma held Shaw on $1 million bond for several days before agreeing to allow his return to Pennsylvania on a parole violation. He was charged with murder on the day of his return to Pennsylvania on January 10.
Shaw was held without bail at Blair County Prison after his arraignment and was remanded to Blair County Prison after a preliminary hearing in late January. A notice of aggravated circumstances was filed in the case on March 3. Shaw plead not guilty to the charges at his formal arraignment that same day.
Shaw’s attorney, Public Defender Ted Krol, told The Daily Herald a hearing is planned on a change of venue motion he has filed in the case. Krol is seeking to have a jury outside of Blair County decide the case due to the publicity surrounding it. He also said he is currently working on a pre-trial motion that he plans to file in the next few days to have some of the prosecution’s evidence excluded.
In addition to facing the death penalty in the murder case, Shaw also faces charges of assaulting the boy’s mother at the Pennsylvania Avenue apartment where Klein’s murder took place.
Shaw was in the news again recently after reports of an alleged assault against an officer at the Blair County Prison. Shaw was transferred from the prison to SCI Houtzdale after he allegedly assaulted an officer at the Hollidaysburg lockup on Sept. 11. SCI Houtzdale opened in 1996 and is a medium security facility for men located in Clearfield County.
Sergeant David Gehret of the Hollidaysburg Police Department confirmed that an incident that happened Sept. 11 at Blair County Prison is being investigated by his department. He said the case involving the assault of the prison officer is being reviewed by the Blair County DA’s office. Gehret said it was likely charges would be filed at a later date. DA Richard Consiglio did not return a call by press time to comment on Shaw’s trial date and the prison incident.
