HOLLIDAYSBURG, Pa. (AP) — A Blair County judge has rejected an appeal by a 27-year-old man convicted of assaulting a county jail guard.
A jury found Nathan Shaw of Tyrone guilty in the 2006 assault of a guard who suffered a broken nose and cut to his head.
Shaw was in the lockup awaiting a murder trial. He now is serving a life term without parole for fatally stabbing his ex-girlfriend’s 6-year-old son in 2005.
Shaw challenged his assault conviction, saying the verdict was inconsistent because he was acquitted of aggravated assault, but found guilty of assault by prisoner.
Judge Tim Sullivan says there was enough evidence presented at trial to warrant the jury’s decision.
